MIGRANT EDUCATION PROGRAM
PARENT ADVISORY COMMITTEE
BY‐LAWS
A Migrant Education Program (MEP) Parent Advisory Committee (PAC) shall be established in accordance with Title I Part‐C Education of Migratory Children (MEP).
ARTICLE I NAME
Section 1 The name of the committee shall be the Kiona-Benton City School District Parent Advisory Committee.
ARTICLE II PURPOSE AND FUNCTION
Section 1 The purpose of the PAC shall be to represent the interests of the children served by the MEP in the Kiona-Benton City school district.
Section 2 The function of the PAC shall be to advise the Local Educational Agency (LEA) on the planning, operation, and evaluation of MEP programs and projects in which their children participate.
ARTICLE III COMPOSITION
Section 1 The membership shall be comprised of at least a simple majority (51% or more) of parents and guardians of eligible migrant children [WAC 392‐164‐365]. The remainder of the committee (49% or less) may be made‐up of those individuals who represent the interests of such parents.
ARTICLE IV MEMBERSHIP AND VOTING
Section 1 The PAC members shall be elected by the parents of children served by the MEP of the school district at a meeting to which they have all been invited. If elections are not possible, the LEA may select members by appointing volunteers or those nominated by other parents, teachers, or administrators. In any event, the method the LEA selects should provide for maximum parent participation.
Section 2 Each voting member shall be entitled to one vote and may cast that vote on each matter submitted to a vote on the PAC. Absentee ballots shall not be permitted. In case a vote ends in a tie, another meeting will be scheduled to cast a new vote.
ARTICLE V OFFICERS AND TERM OF OFFICE
Section 1 The PAC officers shall be elected by the members of the PAC for a term of two (2) school years.
Section 2 The PAC officers shall consist of a president, a secretary and two (2) representatives.
Section 3 The president shall preside at and govern all meetings of the PAC and will sign all letters, reports, and communications of the committee. In addition, he/she shall perform all duties incident to the office of the president and such other duties as may be prescribed by the PAC.
Section 4 The secretary shall take and keep copies of the minutes of all general and special meetings of the PAC. He/she shall also be custodian of all reports, agendas, record of who attends the meetings, and current register of addresses and telephone numbers of the PAC membership.
Section 5 The representatives shall be prepared to serve as an official when necessary. They shall be the first to be called to occupy an officer’s chair in the case of a resignation or termination of term.
Section 6 An officer of the PAC may resign from his/her position by presenting a letter of resignation explaining their intentions. No action is necessary except to recognize the letter on the part of the PAC members. In case there is a resignation from the president, a new president shall be designated from among the actual representatives. A new representative will be appointed.
Section 7 Any officer elected or appointed by the PAC or LEA may be removed by a two‐thirds (2/3) vote of the PAC, when, in the judgment of the members, the best interests of the committee would be favorably served.
Section 8 An appointment will also be terminated if an elected officer transfers their actual residence from the borders of the LEA.
Section 9 Vacancies in any office may be filled by an election at the next scheduled meeting of the committee.
Section 10 PAC officers may send an alternate to represent him/her for no more than two (2) general meetings. An alternate shall have voting power.
ARTICLE VI MEETINGS
Section 1 The meetings of the PAC shall be announced and open to the public and school district representatives. A special meeting may be called jointly by the president, the federal projects director or by a majority vote of the PAC.
Section 2 The PAC shall meet at least 3 times during the school year.
Section 3 The PAC shall conduct its general and special meetings in a facility provided by the school district.
ARTICLE VII QUORUM
Section 1 A simple majority (51%) shall constitute a quorum necessary for the transaction of the business of the PAC.
ARTICLE VIII SPECIAL COMMITTEES
Section 1 The PAC shall establish special committees as deemed necessary to oversee specific tasks and/or requests made by the PAC. Special committees will not exercise power over the PAC. The president may appoint PAC members to various committees. Members may also volunteer to serve in special committees.
ARTICLE IX PROCEDURE FOR AMENDING BY‐LAWS
Section 1 These bylaws may be amended when it is necessary by a two‐thirds (2/3) majority vote of the PAC and approval of the superintendent or school district board of the LEA.
ARTICLE X LIMITS OF AUTHORITY
Section 1 The PAC shall have no power to enter into contracts of any nature or dispense public funds and shall operate at all times under the federal and state guidelines. The PAC shall have no powers beyond those expressly set forth herein.
IN WITNESS THEREOF, the superintendent of The Kiona-Benton City School District and the president of the Kiona Benton City School District Parent Advisory Committee have caused these bylaws to be duly executed on the __________day of ____________ 20___.
